Serowe court fines man

Jayson Titus, 30 could face the wrath of the law for allegedly identifying himself as Richard Budenhorst.

Facts before court are that on January 17, 2014 at Boiteko Junction Mall in Serowe, the accused identified himself as Richard Budenhorst after failing to avail a driver’s licence to the police. The accused was  charged with a single count of driving a motor vehicle , while alcohol content in his breath was 0.80 mg per 1000 ml  exceeding the prescribed permissible limit of 0.22mg per 1000 ml.

At the police station, the accused produced an identity card bearing Jayson Ricardo Titus not Richard Budenhorst.The police later charged him with a single count of giving false information Contrary to section   123 of road traffic act, Cap 69.1.The offence attracts a monetary fine of between P1000 and P3000 or imprisonment term not less than 12 months but not more 18 months or both.

The accused pleaded guilty to both charges but on Tuesday when he was to be sentenced Serowe principal magistrate Kgololesego Segabo pronounced that because Titus claims that both names are his, he should be tried for second count of giving false information. Meanwhile when principal magistrate Segabo asked him about the alleged names, the accused told the court that Budenhorst is his mother’s name while he said Richard was his other name.

“But we all have mothers why don’t we use our mothers name” principal magistrate stated Meanwhile the  accused was convicted for drunken driving and   was fined P3 000 or  go to prison for 18 months. He was   also disqualified from driving or obtaining a drivers licence for a year. BOPA
