COURT ACQUITS MOREMONG IN SEFALANA CASH-IN-TRANSIT ROBBERY
The sole accused person in the Gaborone West Sefalana Cash and Carry cash-in-transit robbery and shoot-out, which led to the death of four assailants and one standby customer, has been found not guilty and acquitted of the offence of robbery.
Thabo Moremong was acquitted by Village Magistrate Ms Tshepo Thedi on Thursday, who said the state had not proved the case beyond reasonable doubt that the accused knew about the robbery.
He was facing a single count of robbery on 25 November 2022 at Sefalana Gaborone West for acting jointly and with a common purpose with persons not before the court to steal about P649,864.73 belonging to G4S Security in transit cash services.
Actual force and violence were used in obtaining the said amount, and a shootout ensued, leading to the death of four assailants and one standby customer, Kebadirele Dikago, who worked for CEDA.
Magistrate Thedi noted that it was not in dispute that an offence of robbery took place and that the accused was the driver of the Toyota RunX motor vehicle used to transport the assailants.
However, she said what was in dispute was whether the accused acted jointly and with a common purpose with the assailants.
She added that the accused had told the court in defence that he was instructed by one Leatile Modise to pick up the four men and transport them, and that he was not aware of the robbery plan.
She said the accused stated that he only got to know about the robbery upon arriving at Sefalana, when the assailants got out of the car and attacked G4S Security employees, and that he ran for cover under a parked Honda Fit vehicle, where he was eventually arrested.
She noted that the state had not adduced any evidence or information suggesting the accused knew about the intended criminality, adding that none of the state witnesses alluded to the accused taking part in the commission of the crime, nor to attacking or carrying a gun.
She further noted that no evidence before the court established that the accused shared the criminal purpose with the assailants, except that he drove the Toyota RunX.
