Magistrate Expresses Fury Over UB employee murder

Chief Magistrate Kamogelo Mmesi of Extension II Magistrate Court has expressed frustration over the murder of a University of Botswana employee, saying someone from the prosecution should be held accountable for the deceased’s death.

“This lady died because I granted this man bail. We also feel the pain,” Ms Mmesi said during the accused person, Bantshuti Nkgarapi’s appearance in court today.

She said the prosecution withheld information on the restraining order, which had been granted against the accused during a previous bail application, where he faced a threat to kill charge and was subsequently granted bail.

She explained that had the court been aware of the restraining order, a different decision would have been reached.

Nkgarapi (37), unemployed, is accused of killing Magadi Mokganelwa on Monday at the University of Botswana, where she worked by allegedly stabbing her with a sharp instrument.

His plea was reserved on the murder charge and he indicated to the court his intention to obtain legal representation.

He also requested a transfer to Mochudi prison to be closer to a sibling, who could provide care, and further cited discomfort with the smoking and drug use at Gaborone Central Prison, where he was currently incarcerated.

Furthermore, Nkgarapi requested court protection for his property, claiming that during a visit to collect medication, he discovered his belongings had been taken by the deceased's relatives.

However, Magistrate Mmesi denied the transfer request, stating that the accused person needed to provide a medical report to substantiate his claim.

Earlier, state prosecutor Mr Pascal Mhandu informed the court that the state would oppose any bail application from the accused person.

He said should he apply for bail, the state would require him to demonstrate exceptional circumstances.

Mr Mhandu said the state’s position was based on findings indicating premeditated murder, but noted that the state position would be deliberated when the accused makes his application.

In addition to the new charges of threat to kill and murder, Nkgarapi was acquitted last year of a single rape charge after the victim withdrew the case, when the trial was about to commence.

Nkgarapi, a pastor at the Progressive Ministry Apostolic Faith Healing Church, was remanded in custody and will appear for mention on July 3. ENDS
