Ruling on urgent appeal in Morupisi case Wednesday

Justice Mercy Garekwe of the Court of Appeal (CoA) will deliver a ruling on Wednesday (January 8) concerning an expedited appeal filed by the Directorate of Public Prosecutions (DPP), following the High Court's decision to set aside the imprisonment of former Permanent Secretary to the President, Carter Morupisi.
The announcement was made in a packed courtroom this evening.
Mr Tshiamo Rantao and his team, representing the DPP had earlier argued that the matter should be expedited due to its public interest implications, which he said challenged the integrity of the highest court.
He added that the High Court lacked the jurisdiction to overrule decisions made by the CoA.
The DPP also contended that Judge Dr Zein Kebonang should have recused himself from the panel, as his mother received a car and his brother received funds from the respondent, raising concerns about potential bias.
In response, Dr Obonye Jonas, representing the respondent, argued that the case did not present a threat to public interest but rather the interest of the public.
He argued that in a democracy, criticism of the court was acceptable and could enhance societal dialogue, asserting that it did not directly jeopardise the integrity of the CoA.
On the matter of recusal, Dr Jonas noted that no allegations of bias against Justice Kebonang had been made in the CMB case. ENDS
