Ndjavera fails to undergo second psychiatric exam
14 Nov 2013
A defence attorney in a double murder case, Mr Kabelo Gaonyadiwe has told the Francistown Magistrate Court that a second psychiatric examination could not be performed on his client.
In a brief appearance before Magistrate Sijabuliso Siziba, Mr Gaonyadiwe said although a court order was issued to have the accused, Thebe Ndjavera sent for a second psychiatric examination, it could not be done.
Mr Gaonyadiwe said he was informed that since the first psychiatric report was done and a report availed, the second one could only be done at the expense of the defence. He further informed the court that he would follow up the issue as he was not conversant with the procedure of requesting for re-examinations.
However, the state counsel, Mr Chimbisane Sechele said the procedure was that if the defence needed a second opinion, it should bear the costs. Ndjavera is facing two counts of murder of his two daughters aged two and four years old.
He reportedly used a sharp instrument to murder the children in February this year in Somerset East location in Francistown. Magistrate Mr Siziba set November 29 as the next date of mention. Ends
