The state intends to file a supplementary affidavit to the effect that one of the accused persons in the gruesome murder of a Kopong teacher was interfering with a key witness.
The state prosecutor, Keletso Ookeditse told the Broadhurst Magistrate Court on Thursday, when the four accused persons appeared before Magistrate Jobbie Moilatshimo, that, “We intend to file supplementary affidavit which relates to interference with the key witness by one of the accused.”
The accused persons; Oageng Letsholo (46), Leufty Kosie (47), Outlwile Aston (48) and Kebaleboge Ntsebe (42) are facing a single count of murder and they had since been remanded in custody.
Ms Ookeditse said the supplementary affidavit could have long been filed, but was delayed as the investigating officer was out of town to make further investigations, adding that the investigating team was making progress.
Ms Ookeditse told the court that a social worker had been identified for the 12-year-old child witness and would be meeting the child on September 8.
In addition, she said the investigating officer was advancing investigations in Maun and would then proceed to Francistown.
The said areas, she said, were places that some of the accused persons claimed they were visiting during the fateful day.
However, defence attorney, Mr Kagiso Tamocha, who was standing in for Attorney Kgosietsile Ngakayagae, who is representing Kosie, said they intended filing an answering affidavit to the prosecution supplementary affidavit.
Mr Tamocha also requested that the investigating officer be ordered to appear in court during the next appearance as they intended to apply for bail.
Attorney Unangoni Tema for the late teacher’s husband, Aston, told the court that the supplementary affidavit did not concern his client.
Mr Tema said he would be ready to argue for his client’s bail during the next court appearance and that they would file their application on September 8.
“The state will have to reply so that we will be ready for arguments on September 14,” he said.
The four accused persons are scheduled to appear again before Magistrate Moilatshimo on September 14.
During their appearance, Magistrate Moilatshimo will give a ruling on whether or not to give the fourth accused person, Ntsebe bail.
Magistrate Moilatshimo said she was not ready to rule on the matter as she had been out of office.
The third accused person, Aston and second accused Kosie through their lawyers, are also expected to argue for their release on bail. ENDS
