Prosecution team fails to honour promise

The prosecution team in a case in which Isaac Kgosi is facing two charges of disclosing the identity of DIS agents and obstructing them in their course of duty, told the Broadhurst Magistrate Court on August 14, that they could not give the defence team the necessary documents they had agreed to avail in the last court mention.
Mr Boikobo Moseki, representing the prosecution told Principal Magistrate Gaseitsiwe Tonoki, who was clearly not pleased with the developments, that the delay was caused by some administration problems they had experienced.
Mr Tonoki told the prosecution team to ensure that they gave the defence the documents so that the matter could continue.
For his part, Kgosi who was without his attorney told the court that the reason he came alone was that the prosecution was supposed to contact his attorney but that did not happen.
He was just passing-by the court and learnt that his case was on the court roll.
In the last court appearance, Attorneys Thabiso Tafila and Lesley Malema representing the accused told Chief Magistrate Linah Mokibe – Oahile that the prosecution did not furnish them with the necessary documents to prepare and therefore their client was not ready to plead.
Mr Malema had stated that the prosecution’s response was not satisfactory.
“We cannot proceed with the matter and even setting trial dates when we still have issues to settle,” said Mr Malema.
On the other hand, the public prosecutor, Ms Thato Dibeela had told the court that the prosecution had fully responded to the request made by the defence team as they had furnished them with all the necessary material.
Ms Dibeela had argued that the defence team was engaged in some delaying tactics.
The two parties agreed on a postponement to August 27, with the prosecution promising to furnish the defence with all the documents they needed, well on time. BOPA
