Officer charged for obtaining by false pretences

Chief Magistrate Lenah Mokibe-Oahile has sentenced a 48-year-old man to 18 months imprisonment, wholly suspended for three years on condition that he does not commit a similar offence during the suspension period.
A press statement from the Directorate of Corruption and Economic Crime (DCEC) states that Sam Mutoriti was charged with two counts of Obtaining by False Pretences, contrary to Section 308 as read with Section 307 of the Penal Code (Cap 08:01) Laws of Botswana.
The release further states that during the trial it was discovered that the accused person, Mutoriti, in the period between November 2009 and April 2010 in Gaborone, with intend to defraud, obtained P1 500 from Felix Majebe pretending that the aforesaid amount represented consultation fees, when in fact and in truth all legal fees including consultation fees were covered by the Government of Botswana and as such he was not entitled to the money at the time he made the representation and he knew at all material times that it was false.
On the second count the accused obtained P3 000 from Majebe by falsely pretending that the aforesaid amount represented expenses he incurred in the conduct of a criminal matter in which the latter is facing a single count of murder, and as such he was entitled to the money which representation he knew was false.
Mr Andria German of the DCEC appeared for the state while the accused was represented by Thabiso Tafila of Michin and Kelly law firm. ENDS
