Prosecution applies for charge substitution

Sergeant Maureen Segokgo has applied for the substitution of a charge of unlawful wounding to that of murder against a 44-year-old South African.

Briefing the Molepolole Magistrate Court recently, when appearing on behalf of the substantive prosecutor, Assistant Superintendent Seth Tau, Sergeant Segokgo said the victim had since died, hence subsituting the charge.

When updating the court on the progress of the case, Sergeant Segokgo said investigations were at an initial stage therefore applying for the remand of the accused so that he would not interfere with investigations.

She also stasted that the accused was not a citizen of Botswana and so a flight risk.

For his part, the accused told court that there had been confusion as to where he stayed, saying he was born in South Africa, but living in Molepolole at Phalane ward.

He said he had applied for citizenship and that he had some documents to attest to that.

When Magistrate Lindiwe Makgoro quizzed him if the citizenship had been granted, he said it was not yet granted.

The magistrate informed him that as long as that citizenship had not yet been granted, he remained a South African citizen.

According to the charge sheet, Steven Moatshe on the November 25 at Phalane ward in Molepolole murdered Ms Anna Mokoka. The accused would appear again before court on the December 23. ENDS
