Alleged cattle rustler on bail

Alleged habitual cattle rustler, Tshepiso Zulu aged 43 years of Borakalalo ward in Molepolole has granted bail by Lobatse High Court, Justice Michael Leburu after prosecution failed to appear and oppose bail application on November 10.
The accused was denied bail by Molepolole magistrate, Mr William Modise after prosecution represented by principal prosecution counsel Farayi Mahwite successfully cited violation of bail conditions by the accused from numerous cases of stock theft. A decision to grant the accused bail was reached after DPP counsel failed to challenge the accused’s application.
The presiding judge, Justice Leburu granted Zulu a conditional bail by ordering him to produce two sureties each binding himself with P1 000.
He is also to report to Molepolole Police fortnightly on Mondays between 8am and 5pm and should also surrender travellers documents to Molepolole station commander as well as to attend all scheduled court dates.
The applicant who has more than 15 stocktheft cases and one of murder has constantly been granted bail by different magistrates including the High Court. Attorney Sesupo Masaka of Manchwe Masaka Attorneys confirmed to had served concerned parties being the Department of Public Prosecution (DPP) and High Court with relevant documents such as the affidavits and the Notice of Service, but did not saw any opposing affidavit, but went on to advance their intentions.
Attorney Mahwite, principal prosecution counsel with DPP, who previously handled the matter told BOPA that he was not aware of any urgent application by the applicant regarding the matter.
Contacted for comment, Molepolole Station Commander, Superintendent Charles Mbengwa stated that although they were handling all of Zulu’s cases, they were not aware of the defence bail application to the High Court because it was being handled by DPP. End
