30 May 2016

A New Era College student Ndiwo Molefi (22) has pleaded guilty to a charge of drunken driving.

Consequently, Magitrate Rosemary Khuto of Molepolole fined Molefi P3 000 to be paid by October 1.

Failure to pay would result in the accused being imprisoned for nine months.

The accused was charged for drinking above the prescribed limit alcohol.

The court heard that the accused was stopped by the police on February 28 along A10 road at Kumakwane.

The police officers established that the accused was smelling alcohol hence they tested him for drunken driving and the results came out positive.

The prosecution presented the breathalyser certificate and the operating officer’s qualification to operate the machine as evidence before court.

When given a chance to mitigate, the accused pleaded with the court to be lenient with him stating that he was still a student and it was also his first offence.

He also pleaded with the court not to confiscate his licence as it played a major role in the course he is doing at school which is Structural Mechanics.

When passing judgement, Magistrate Khuto said she took into consideration that the accused pleaded guilty and did not waste the court’s time and that he was a first time offender. Ends
