Magistrate advises suspect to comply
11 Aug 2015
Molepolole Senior Magistrate, William Modise recently advised Motserekane Gadienewe, 54, of Motlhabane ward in Thamaga to comply with reconciliation conditions laid before him by the complaint, as failure to comply will lead to him being sentenced to jail.
Gadienwe is facing a single count of stock theft. The accused is said to have fraudulently and without any claim of right stolen a cow branded on its left thigh, valued at P6 000, and a calf without any brand mark nor ear mark valued P 2 500 belonging to Sebereki Joseph Baruti between the 15th and 16th of May 2015 at Peloyatloane lands in the Kweneng District.
He is said to have branded the cow and calf with his brand and ear marked them with his own ear markings. He consented to all the facts read to him by the court.
The complainant had agreed to reconcile with the accused provided that he pays 5 beasts and a calf.
Senior Magistrate Modise said Gadienewe should have paid or complied with the conditions on or before the 13th of August 2015, failing which he will land in jail.
Senior Magistrate Modise ordered the accused person to have complied with reconciliation conditions not within 21 days as proposed by the state prosecutor Sub Inspector Moshe Karabo of Thamaga police, pointing out that Batswana are complaining and worried by high rate of cases of stock theft in the country and the delays to lay charges against the accused persons.
