Ledumadumane murder case fails committal

28 Mar 2013

Attempts to commit the snail-pace one-year-old Ledumadumane murder case to the High Court once again aborted Wednesday because the accused arrived late for court.

Efforts to commit the case hit a snag a week ago when one of the three accused told the court that his committal papers were not in order.

Montwedi Molefe told the court then, that some of the committal papers which he was given by state prosecutor Mr Morebodi Jamba from the Directorate of Public Prosecutions (DPP) indicated that he was both an accused and a state witness which he said confused him, and diminished his understanding of relevant issues pertaining to the committal.

On Wednesday the state left nothing to chance and as served, as soon as they arrived, all the accused, including Montwedi with fresh papers supposedly with no ambiguous statements.  As for coming late, the narrowly escaped being taken in after Mr Jamba convinced the court not to detain them because they had been respecting their bail conditions.

Had they been committed to jail, their bail would automatically lapse and they would have to apply for bail from inside prison.

The accused in the matter are two cousins Mabogo Lesotlho, Kgololo Lesotlho and Molefe. Onneetse Setlhomolane, who was previously charged alongside the trio, has since been released as there was insufficient evidence to link him to the murder.

The trio is accused of jointly and unlawfully murdering Ishmael Moseki during a football match played at Ledumadumane settlement near Mmopane on February 25, 2012. ENDS
