Magistrate extends remand of trio in Kgoro gang rape case

The accused persons in the Kgoro gang rape case have been further remanded in custody.Chief magistrate Ms Rebecca Motsamai of the Lobatse Magistrate Court last week extended the remand of 30-year-old Wabile Mohlomi of Kgoro, Phenyo Khubitla, aged 19, and that of a Good Hope native was a minor when the rape incident occurred in Kgoro on July 11 last year. Ms Motsamai extended their incarceration to July 13, when they will make another court appearance.

The trio is charged with a single count of rape contrary to Section 141 of the Penal Code.The prosecutor Ms Vanzoline Machikiche told court on Friday that the docket was now complete and that the accused persons had been furnished with statements.

During the Friday court session, a sealed video footage from the forensic lab was presented before court, after which the accused persons were then furnished with it.The date for the final case management was set for July 13, during which a ruling on the accused’s bail bid will also be read. Before the date for the final case management was set, the second accused person, Khubitla, asked the court to set a closer date so that the matter could be finalised, arguing that they have been languishing in prison for almost a year now with no progress in their case.

The case will be heard at the magistrates court rather than at the children’s court because the third accused person, who was a minor at the time of committing the offence has now come of age.ENDS
