Man changes plea on rape

A 36-year-old man from Tsolamosese, Mogoditshane, who initially pleaded guilty to charges of rape and robbery, has changed his plea to not guilty.
The accused, Rebaone Marks, appeared before Magistrate Jobbie Moilatshimo on August 19 for the presentation of facts. He had previously pleaded guilty, but after the facts were presented to him, he disputed them and changed his plea.
When Magistrate Moilatshimo asked why he initially pleaded guilty, Marks replied, ‘Mapodise le bone fa o bua le bone ga ba reetse’, meaning, ‘when you talk to the police, they do not listen’.
He told the court that he did not commit the offenses, adding that the victim had simply asked him to accompany her after getting off a combi, and he was not the one who raped her.
According to the facts presented to the court, the victim was attacked from behind by the accused, who hit her on the head with a stone. The assailant, who was carrying a bag with a Chibuku box and armed with a knife, allegedly raped her and fled the scene.
He is also accused of stealing the victim’s phone, handbag (containing her identity card, bank card and P200), perfume and clothing. The facts also indicated that police investigations led to the arrest of the accused, whom the victim also identified.
Marks has been remanded in custody and charged with having carnal knowledge of a woman without her consent in Tsolamosese on May 10, 2023.
He will appear for a final case management conference on September 18. ENDS
