Francistown magistrate denies Holland bail

British national, David Holland’s second attempt to get bail was recently denied by a Francistown Magistrate.

Delivering his ruling on Thursday, Magistrate Tshepo Magetse said the 36-year-old Holland, who is facing four counts of common assault, threat to kill, assault occasioning bodily harm and intimidation, was previously granted bail. However, Mr Magetse said his previous release on bail was revoked on January 23, after the court established that he willingly failed to abide by the set bail conditions. He repeatedly failed to appear before court as and when required to do so.

Despite his failure to abide by the conditions of his previous release on bail, Holland made another attempt to get bail. Mr Magetse said the accused person’s previous bail revocation was informed by his prolonged absence from court for nearly a year.

He said the accused person even failed to pay the P10 000 bail bond which he was ordered to pay after breaching the conditions of his previous bail. Given the circumstances, Mr Magetse said the court cannot proceed to entertain such bail application until the P10 000 bail bond was paid.

The accused person was advised to provide proof that he has paid the P10 000 bond for violating his previous bail conditions. Magistrate Magetse said the application to be released on bail pending trial will be revisited on February 25, while the accused person will be remanded in custody until then. ENDS
