High Court set aside Morupisi imprisonment

Gaborone High Court has set aside a seven-year imprisonment term handed by the Court of Appeal (CoA) to former Permanent Secretary to the President, Carter Morupisi.
Morupisi had approached the High Court challenging the impartiality of Judge Singh Walia of the CoA, following his conviction on three charges of corruption and money laundering.
When delivering judgment on the matter, Judge Zein Kebonang and Judge Reuben Lekorwe agreed that the sentencing imposed by the CoA should be declared a nullity thus reinstating Justice Chris Gabanagae’s previous sentences.
With regard to whether the High Court can set aside a sentencing decision by the apex court, Judge Kebonang stated that such required no answer given that a breach of fundamental human rights rendered a decision a nullity.
Judge Masoko Mathaka held a different view that the matter should be referred back to the Court of Appeal. ENDS
