Old age works for rape accused

Principal Magistrate Queen Moanga of Mochudi Magistrate’s Court on Wednesday granted bail to an elderly man of Boseja ward in Mochudi, who is facing a single count of rape.

The accused person, Mabiletsa Molefe, aged 78, is facing a single rape charge allegedly committed between June and December 2017 at Boseja Ward, contrary to section 141 as read with 142 of the penal code.

Granting him bail,  Magistrate Moanga said the accused person was elderly, hence not a flight risk.

The magistrate, therefore, ordered the accused to report to the police station once a month and ensure that he attended all court sessions.

Before being admitted to bail, the state prosecutor, Ms Laura Gumede told court that the accused person was initially charged for defilement, but the charge had since been amended to rape charge.

Asked to plea after the charge was read to him, Molefe pleaded not guilty, saying whatever he was being accused of was all but lies.

Magistrate Moanga said the state must serve the accused person with all witness statements to enable him to prepare for the trial.

She further advised the accused to ensure they read and understand all the statements as they were core to his defence, adding that if he did not understand, he should request anyone for assistance.

Commenting on his bail condition, Molefe told court that he could only afford to come to court once a month due to his age. The trial date is July 24. BOPA
