Defence lawyer Extenuating circumstances
31 May 2024
The High Court is expected to receive presentation of extenuating circumstances and mitigation in a case in which two men have been convicted for murder.
The case was to continue May 31 but was postponed to July following a request by the defence attorney, Mr Letlhogonolo Makgane to be allowed time to prepare for the case in which the duo of Ernest Legwale and Hamadi Mkhuha were on May 10 convicted for the murder of Thato Meswele in Oodi on September 14, 2015.
Mr Makgane told Judge Michael Leburu of Gaborone High Court that his client, Mkhuha was not ready to present extenuating circumstances and mitigate because he wanted to call three witnesses.
He said one of the two other witnesses was in Zimbabwe while the other was in South Africa and therefore, pleaded with the court to grant him enough time to engage the two witnesses and arrange for their travel to Botswana. Ends
