Court remands GBV accused Toise

27 Oct 2023

Molepolole Magistrate Court denied bail to Tsotlhe Toise, who is facing four accounts of assault occasioning actual bodily harm, disobedience of lawful orders and two assault common charges

Senior Magistrate, Ms Keabetswe Majuta ruled on Thursday  that the accused should be remanded on the basis of having disobeyed a court order issued to him by entering a yard he was restricted from, and going on to assault one Setshego Toise who is the accused's mother.

Magistrate Majuta stressed that the accused had proven to not be a perfect candidate for bail as proven by the evidence and argument by the investigating officer, Constable Basikere Kebatshotse, who stated under oath that she feared for the victim's life should the accused be granted bail.

Ms Majuta said domestic violence was prevalent in the area, and therefore the court could not treat such cases lightly.

She ruled that the most logical thing to do was to remand the accused in custody in order to keep the complainant from danger posed by the accused person.

Toise will appear for mention on November 20. ENDS
