Judgement for a case involving former North West District Council (NWDC) chairperson, Mr Kebareeditse Ntsogotlho and his deputy, Mr Lekonne Masoko has been reserved for next Friday (June 16).
The duo are challenging the legality of how they were removed from office recently in a special NWDC full council meeting and replaced by Boseja South Ward Councillor Itumeleng Kelebetseng and nominated Cllr Nico Folae as chairperson and deputy respectively.
Appearing before Maun High Court Judge Bugalo Maripe on June 8, the applicants’ attorney, Mr Andrew Johannes argued that the duo were removed from office and the subsequent appointment of the new office bearers was unlawful, something he said was enough for an urgent application.
On the other hand, second respondent’s attorney, Mr Martin Dingake representing Kelebetseng, argued there was no case since the applicants had lost a political contest.
Mr Dingake argued that the first applicant was the one who chaired the meeting which led to their ousting therefore said both had a duty to ensure that the meeting was properly constituted according to the standing orders. Thus, he said the case should be dismissed with costs.
Meanwhile, first respondent, NWDC is represented by Attorney Otsweletse Moupo while the third, Folae is represented by Attorney Kebonye Modisa. ends
