Tshane Police officer, Dellion Masalela, accused of raping a suspect in custody, was on Wednesday granted a P500 conditional bail by acting Hukuntsi Magistrate.
The charge sheet has it that on May 21 at Tshane Police Station at the traffic general office, Masalela (26) allegedly raped an accused person currently remanded in custody with other two accused persons for murder.
In her ruling, Magistrate Lilian Madabane ordered Masalela to bind himself with P500 and that he should maintain a distance of 500m away from Tshane Police Station offices.
She also urged him to appear before court whenever summoned and not to interact with the complainant.
The complainant and her counterparts are facing a single count of murdering Kesotlegile Qomqom (28) of Kang, who is alleged to have been murdered on February 28 at Kgamatholo cattlepost.
In his submission, public prosecutor, Sub Inspector Moshe Karabo pleaded with court to remand Masalela since the matter was still new and that investigations were still at infant stage.
He also said the matter was a serious offence that needed thorough investigations as by virtue of his employment Masalela might easily interfere with investigations.
Furthermore, he said the matter was likely to attract public interest as the complainant was under the police custody when the incident occurred.
In his defence, Masalela had told the court that he would self-represent.
He said he should be granted bail as he had complied with all that was required of him by the investigating officer, adding that the complainant was currently remanded, therefore, there was zero chances of him interacting with her.
The accused person is set to appear for the next mention on June 6. ENDS
