Court grants stealing by servant accused bail

Shaka Moilwa (30) of Hukuntsi, who is facing a single charge of stealing by servant was on Tuesday granted a P10 000 conditional bail.
Hukuntsi Magistrate, Ms Galaletsang Ramokate ordered Moilwa to also avail two sureties of P1 000 each.
She ordered the accused person to attend court sessions as ordered and to report to Kang police station every Friday between 730am and 430pm.
In addition, the accused was ordered not to interfere with investigations or witnesses in anyway.
The facts of the matter are that between September 21 and January 22 at or near Phofu lodge near Tsetseng village in the Kweneng District without claim right Moilwa stole a partly burnt Toyota land cruiser, four generators, diesel bowser, three water tanks, two bar fridges, four camp chairs and butcher equipment worth P800 000.
Court heard that the properties came into his possession by virtue of his employment at Phofu lodge.
Appearing for the state, Sergeant Qiniso Ncube said Moilwa had been in custody and therefore they were not objecting to his bail application.
Sergeant Ncube requested the court to order Moilwa to bind himself with P5 000, and avail two sureties of P2 000 each.
He also requested that the accused person ensure that he appeared before court whenever ordered to do so and to report at Kang police station once a week.
Moreover, he said accused person must not interfere with state witnesses or temper with evidence in any way.
Defence lawyer Mr Gosiame Digangwa of Biki & Associates, argued that the state prosecutor had mentioned that the accused person should not interfere with witnesses, and he put it before court that he did not know the witnesses he was referring to.
Mr Digangwa further disapproved the amount suggested to be paid by sureties and pleaded that the amount be reduced to P1 000 each surety.
The accused person will appear for mention on April 18. Ends
