Court denies repeat offender bail

Kanye magistrate Ms Ditebogo Ntuli has ruled that a remand warrant for 27-year old Elijah Rabatho of Moshupa be extended until June 28 when he appears for mention alongside co-accused, Gaofenngwe Mmopi of the same village.
The duo were on Tuesday arraigned before court for a robbery charge, in which they are accused of attacking and robbing Kagelelo Dikuelo of property worth P230 at Sedudu ward in Moshupa on April 15 this year.
Initial list of items included a cellphone, money box, cigarettes and airtime, but the prosecutor, Seargent Linah Bannyaditse requested to substitute the charge sheet since the complainant had found the cellphone which was alleged to have been stolen.
Sgt Bannyaditse further pleaded with court to extend the first accused person’s remand warrant due to his elusive behaviour.
“The first accused person is remanded and I plead for extension of remand warrant because he has a habit of committing offences while on bail.”
The accused persons, who both pleaded not guilty to the charge, were served with witness statements and a medical report form, and are expected back in court on June 28. On a different matter, Elijah is expected back in court on the same date to set trial dates for a case in which he is accused of causing malicious damage to property.
Still before the same court, 27-year old Gofaone Mongwaketse of Motlhala ward in Kanye pleaded guilty to driving a motor vehicle while alcohol content in his breath was over the prescribed limit. The case was initially scheduled for trial, but the accused person ceased the moment to change his plea from not guilty.
The facts of the case indicate that the accused was caught driving a motor vehicle at Sejelo traffic lights in Kanye on June 20, 2021 while his alcohol content was 0.43mg/1000ml against permissible limit of 0.22mg/1000ml. He is scheduled to appear again before court on June 16 for facts reading. ENDS
