Judge postpones Davidsmurder trial postponed

The trial of a case in which two men are accused of killing the former Mochudi East Member of Parliament, Isaac Davids was postponed on Thursday, after one of the defence lawyers was involved in a car accident.

Attorney Mr Opeyemi Ajayi, who represented first accused, Jabulani Dube was alleged to have been involved in a car accident on his way from Tsabong on Wednesday night, a day before the trial.   Therefore, Justice Michael Leburu of Gaborone High Court said the trial could not proceed without Mr Ajayi.

The accused persons, Jabulani Dube and Mokgalemi Maleya, who were employed as herdboys, are charged with the murder of Mr Davids at Sorilatholo on January 14, 2018, and both have pleaded not guilty to the charge.

 The evidence already before the court has detailed how the legislator was allegedly mercilessly stabbed to death by the two accused.

One of the key state witnesses, Mr Ramontie Segwati had previously told the court that the deceased, who was a sitting an MP at the time, was hurled with insults, stripped of his clothes and stabbed several times by the accused.

 The multiple stab wounds were also confirmed by pathologist, Dr Kaone Panzirah-Mabaka when giving evidence before the court last year.

 However, the accused’s lawyers had maintained that their clients were acting in self defence, as the deceased had a gun in the car and was said to have at one point, called his companion to bring the gun, so that he could finish off the accused.

 The second accused person, Maleya who is out on bail, was represented by Mr Bathusi Brown. The accused persons would appear for status hearing to set new trial dates on May 24. ENDS
