Magistrate court dismisses Kgosis fears
14 Dec 2021
There is no need for Isaac Kgosi to fear for his life, as there exists no such threat to him.
Regional Magistrate Mr Masilo Mathaka said this yesterday in response to former director general of the Directorate of Intelligence and Security Services (DIS), Isaac Kgosi’s assertions that he feared for his life.
This was after Kgosi, told the court that he was uncomfortable to report to Sebele DIS offices as the officers there wanted to shoot him.
“I have been threatened by DIS officers,” he said.
The argument on Kgosi’s reporting arose after it became apparent that he had two different court orders from two different matters, which directed him to report to Broadhurst Police station and DIS Sebele office.
Thus, he expressed his misgivings about reporting to the DIS office.
He told the court that he had been reliably informed that the officers would create an altercation upon his reporting at the office so as to create an excuse to shoot him, hence his fear.
Further, the area was restricted and there was no police station commander to report to, he said.
“This man says he fears the Sebele facility.
If a man says I am worried about reporting at the facility, why force him,” asked attorney Unoda Mack who appeared for Kgosi.
However, Magistrate Mathaka posited no one was after the former security agency boss, or else he would have reported the matter to the police.
However, Kgosi said he had done so, but no action had been taken. Magistrate Mathaka would however have none of.
The court, said the regional magistrate, would not entertain perceptions, as there was clearly no such threat to Kgosi’s life.
Magistrate Mathaka clarified that reporting was done to ensure the suspect was still available.
“We are not going to argue about reporting. I am not going to allow argument about this.
To me it is a non-starter,” he said. In the end however, he allowed Kgosi to continue reporting to Broadhurst police station.
The former DIS boss is facing charges of unlawful possession of armoured military vests, of ammunition without license, fake passport bearing the names of Lerato Hilton issued by the government and two passport specimen, which the state has argued are prejudicial to the interest of the country contrary to the national Security Act.
