Court grants Kgosi bail

Former Director General of Directorate of Intelligence and Security (DIS), Isaac Kgosi has been granted a conditional bail.
Magistrate Masilo Mothaka of Broadhust Regional Magistrate Court admitted Kgosi to a P30 000 bail on Thursday, which the state did not oppose.
The bail was granted on condition that the accused provide two sureties who will each bind themselves with P20 000.
The former DIS director was also informed not to interfere with witnesses and investigation.
The magistrate said the accused would be provided with the list of witnesses.
Further, Kgosi was informed to report to the DIS offices at Sebele and to honour all court appearances when required.
However, the accused expressed reservation about reporting to the DIS office and asked the court to rather direct that he should report to the police station commander.
Magistrate Mothaka said the court would deal with the issue during his next appearance.
Kgosi was on November 02 granted bail by the village magistrate court, which the state vehemently opposed and appealed at the High Court.
Gaborone High Court Judge, Justice Michael Motlhabi set aside the lower court ruling and said the matter should appear before a different magistrate on November 11. The judgment brought confusion among the state and the accused’s team on whether the setting aside of the magistrate court judgment meant Kgosi was to be remanded.
He was subsequently rearrested and his legal team made an application for the interpretation of the judgment.
Justice Motlhabi said the judgment was never to remand the accused in custody.
The accused was then released to await his appearance before a different magistrate.
Kgosi is charged with unlawful possession of armuored military vests, possession of ammunition without license, fake passport bearing the names of Lerato Hilton issued by the government of Botswana and two passport specimen. The case is scheduled for status hearing on December 14. ENDS
