Oagile Rapekenene, who is accused for motor vehicle theft, is scheduled to appear for mention before Kanye magistrate, Ms Ditebogo Ntuli on May 20.
The 24-year-old man of Manyanda ward in Tonota briefly apeared before court yesterday when the prosecution had promised to arraign the second accused, but failed.
Rapekenene was first arraigned before court on Friday, charged with a single count of motor vehicle theft and was then granted cash bail after the prosecution failed to give court sufficient reasons to extend his remand.
The particulars of the offence indicate that the accused person unlawfully and with intent to permanently deprive the owner thereof, stole a red Honda Fit motor vehicle valued at P30 000 being the property of Tiroyaone Kophuting on April 29 at Jerusalema ward in Moshupa.
The public prosecutor, Mr Cyril Rampefe of Moshupa police had (on Friday) pleaded with the court to extend the accused person’s remand to allow for investigations to be concluded and for the second accused person, yet to be arrested, to be arraigned before court.
The accused person requested that he be granted bail so that he could look for an attorney.
He said he had been in police custody for four days and extending his remand would be unreasonable.
Ms Ntuli said that the court was not satisfied with the prosecution’s arguments for opposing bail.
Consequently, she ordered that the accused person be granted cash bail of P6 000, provide two sureties who would bind themselves with P1 000 each and also for the accused to appear every time as requested by the court.
The case was scheduled for mention on May 10, where the second accused person in the matter was expected to be arraigned. Ends
