DPP to provide forensic affidavit in Ndjavera murder case
03 Oct 2013
A state counsel in the case in which a 22 year-old man, Thebe Ndjavera allegedly murdered his two toddlers early this year has told court that a forensic affidavit on the matter is expected in a week’s time.
Briefly appearing for the state, Mr Chimbisane Sechele of the Directorate of Public Prosecutions (DPP) said the report would be availed to court in the next mention.
He also said the accused would be sent for psychiatric re-examination as requested by the defence. The defence counsel, Mr Kabelo Gaonyadiwe of KK Sechele Attorneys appreciated the prosecution’s agreeing to take the accused for a psychiatric re-examination.
Mr Gaonyadiwe told the court that they have arranged with the Jubilee Hospital Psychiatric Unit for the examination to be done and they only needed a court order to that effect. He explained to the court that the purpose of the re-examination was to establish if they could pursue a further bail application.
Mr Gaonyadiwe said the prosecution had previously raised fears concerning the results of the first examination and the second one would determine whether those fears still existed. Magistrate Sijabuliso Siziba ruled that a re-examination be done and a report filed with the court. He set another mention date to October 16.
Ndjavera is facing two counts of murder for his two toddler daughters aged two and four years old. It is alleged that he used a sharp instrument to murder the toddlers in February in Somerset East location in Francistown. ENDS
