Chief Magistrate Thebeetsile Molalu of Maun has denied 31-year-old man of Sehithwa, Moses Mbimbu, bail for a single count of rape.

Particulars of the offence are that the accused on June 6, 2018 found the complainant who is wheel chair bound alone at home in Bodibeng.

He  allegedly asked the complainant the whereabouts of her mother then dragged the complainant inside the house and had sex with her without her consent.

The complainant later crawled to the neighbours to inform them about her ordeal.

Chief Magistrate Molalu said the court had to consider whether the accused did not have potential to commit a similar offence if granted bail, the kind of offence committed and the strength of the case.

As such, the magistrate said the court concluded that the accused was not suitable for bail since he had absconded court for about 11 months. He said the accused absconded from September in 2019 when the trial was to start until he was arrested sometime in August 2020.

Mr Molalu said the accused did not give a reasonable explanation for his absconding, which showed that he did not take the court seriously.

The accused would appear for mention on February 19.

In another case, Thapelo Garenne (30) was arraigned for defilement. Particulars of the offence are that the accused person had a relationship with the 16-year-old girl in June 2018.

The accused person allegedly had sex with the complainant, which led to the complainant falling pregnant.

The complainant allegedly went to register for pregnancy in January 2019 where she was advised by a nurse in charge to register a case against the accused since she was underage.

A DNA test was done after the child was born and it proved that the child was the accused’s child.
Questioned on whether he agreed with the facts read, the accused said he agreed that he was in a relationship with the complainant, but said the complainant told him she was 17 not 16 years as stated. ENDS
