Defence application to be argued September 25

Chief Magistrate Linah Mokibe-Oahile of Broadhurst Magistrate Court says defence application showing displeasure at the service rendered by the prosecution team will be debated on September 25.
She said this recently during a court case where Isaac Kgosi faced two charges of disclosing identity of Directorate of Intelligence Security (DIS) agents and obstructing them in their course of duty.
In the recent past court appearances, the defence team had indicated that the prosecution had not provided them with all the necessary records.
On one hand, the prosecution was adamant that they had served the defence team with all they had and therefore, had nothing more to offer.
The defence team led by Mr Thabiso Tafila, therefore, filed an application in relation to the insufficient material they had received from the prosecution. The defence filed its application on July 17.
Even though the application was earlier scheduled for arguing on August 14, it did not materialise since the prosecution failed to file answering affidavit on time.
The prosecutor, Mr Boikobo Moseki acknowledged that their answering affidavit was not filed on time. “We have served the defence team with our responding affidavit, even though it was done after the set date and therefore we advise the court to set the date for the application to be argued,” said Mr Moseki.
