Triple murder case mentions today

A case in which Kativa Diwanga is accused of the murder of three people is set to continue today.

According to particulars of the case, Diwanga killed Mr Methulesi Musoliwa, Ms Sibongile Marks and their child, Mellissa Marks on June 10, 2019 in Gaborone’s Tsholofelo East.

Diwanga, who is currently on bail, would appear before Broadhurst Chief Magistrate Linah Mokibe-Oahile for status hearing.

His defence had been that he was framed by one Thomas Gilala and did not personally know the deceased persons.

Gilala, who had been in police custody in Namibia since the incident, reportedly entered that country through an ungazetted point, therefore could not be released and be extradited to Botswana.

In the December 2019 mention, the state said it was still awaiting extradition of the co-accused and until then, there would be no developments in the case.

The Directorate of Public Prosecution (DPP) stated that it was not easy to extradite Gilala since Botswana and Namibia did not have an agreement.

Diwanga’s lawyer, Mishingo Jeremiah had on a number of mentions, argued that his client was not supposed to suffer because of the state’s failure to extradite Gilala.

The state would be expected to give a progress report. ends
