BancABC fraud and cyber crime case set for February

The case in which Trevor Boiteto, Omphemetse Kedikilwe, Waltord Holdings, Mooketsi Kedikilwe and Boldmark Engineering are accused of fraudulently obtaining money from BancABC has been postponed to February 12, 2020.
Appearing for Boiteto, Advocate Unoda Mack told court that he had just received the amended charge sheet and as such, looking at the magnitude of the case they were in no position to go on with it before looking at the amended sheet.
On count 1 the statement of the offence is that contrary to section 15 (2) (a) of the cyber crime and computer related crimes Act (cap 08:06 laws of Botswana , Boiteto on or about November 8, 2018 whilst employed by Banc ABC as the Bank’s money market dealer, with an intent to procure an advantage for Mooketsi Kedikilwe and his company,Boldmark Enginering , fraudulently electronically transferred US$ 200 000 from BancABC’s Citi account number 36243207 to Mooketsi and Boldmark Enginering's bank accounts.
On count 2 Boiteto is accused of fraudulently electronically US$ 200 000 to Omphemetse Kedikilwe and Waltord Holdings' accused bank accounts thereby causing financial loss to the bank and on count 3 and 4 still contravening section 15 (2) (a) Boiteto fraudulently electronically transferred USD300 000 and USD 500 000 to Mooketsi and Boldmark Engineering.
The prosecution alleges that on count 5 and 6 contrary to section 47 (1) (b) as read with section 47 (3) of the proceeds and instruments of crime Act (Cap 08:03) laws of Botswana, Boiteto, Omphemetse, Waltord holdings (PTY) (LTD) acting jointly and with common purpose, received US$ 64 239.49 knowing or suspecting or having reasonable grounds to suspect that the moneywas derived or realised in whole or in part, directly or indirectly from the commission of a confiscation offence, to wit, cyber fraud.
On count 7,8 and 9 Acting jointly and with common purpose Boiteto, Mooketsi, Boldmark engineering (PTY) LTD acting jointly and with common purpose on different dates received a sum of at least US$ 10 000 amongst themselves.
The plea has been reserved and the accused persons will appear again on February 12, 2020. Ends
