Court imprisons two plot sale fraudsters

Two men have been sentenced to seven years each for obtaining by false pretenses. The offence is a contradiction to Section 308 of the Penal Code (Cap 08:01), Laws of Botswana. The particulars of the offences are that the accused persons: Kabelo Mokgalajwe and Peter Moagibetween September 4, 2009 and April 9, 2010, at or near Gaborone, acting jointly and with a common purpose, defrauded seven victims.
On count one, the accused persons obtained the sum of P60 000 from one Thelma O’Reilly by falsely representing to her by words and conduct that Plot 760, situated in Mmopane Block 1, belonged to the first accused person, Kabelo Mokgalajwe when in fact, he had no lawful right or title over the aforementioned plot.
The duo went on to obtain the sum of P67 000 from Tshwano Modimoosi by falsely claiming that Plot 763 in Mmopane Block 1, belonged to Mokgalajwe.
The duo went on to defraud other five victims, still in Mmopane Block 1, and in the process getting away with a total of P180 000. The accused were sentenced to seven years imprisonment on each count and the sentences are to run concurrently. ENDS
