Kanye magistrate denies rape accused bail

A Kanye magistrate court has denied a 47-year-old man of Diboto ward in Moshupa bail to allow for police investigations to be concluded.
Biki Makwati is accused of unlawfully having carnal knowledge of a nine-year-old girl on October 17, 2019 at Diboto ward in Moshupa. Appearing before Kanye magistrate Mr Daniel Nkau on Monday, Makwati pleaded with the court to grant him bail so that he could to attend to his livestock at the cattle post. He also said he needed to go and sell some livestock to raise funds for his legal fees as he intended to engage an attorney.
However, the prosecutor Mr Cyril Rampefe opposed bail request, indicating that investigations were still ongoing and that they had sent some samples to the forensic laboratory.
He further noted that the accused person’s life was in danger as the residents had assaulted him at some point. The magistrate ordered that the accused be further remanded in custody for his own safety and also to allow for police investigations.
The case continues on November 18, 2019.
Still before the same court, a 21-year-old man of Mookodi ward in Kanye is expected to call two witnesses in a case in which he is accused of raping a 20-year-old woman at Kgano ward in Kanye on November 11, 2017.
Even though the accused, Thato Kabomo, who was 19 years at the time, had filed for a no case to answer and had opted to remain silent, told the court that he intended to call two witnesses who were with him at the time of the incident.The court ordered that the prosecution should liaise with the accused person to notify the witnesses so that trial could continue on November 20, 2019.
