Moagi case commits to High Court

16 Sep 2018

Gaborone Extension II Magistrate Court on September 14 committed Aplee Moagi to the High Court for trial after the prosecution satisfied all committal requirements.

Moagi is facing two counts of rape and the murder of a nine-year-old former Thebe Primary School pupil in Gaborone early this year.

His victim was found dead at White City and preliminary investigations revealed that she was raped before being killed.

Her mother had left the deceased together with her younger sibling alone at night and the accused allegedly took advantage of the situation.

Before being committed, the prosecutor, Ms Elang Keitumetse told the court that Moagi had been served with all necessary documents during the previous court session to study hence the application for his committal to the High Court for trial.

For his part, Moagi requested the court to give him the typed bail ruling which he planned to use to apply for bail at the High Court but was advised that it would not serve any purpose and that he could submit his bail application at the higher court straight away.

Moagi’s bail application failed on several occasions before Magistrate Batho Kgarethwa as he could not satisfy some conditions though the court was amenable to granting him bail.

Chief among the conditions he failed to satisfy was the fact that all the people he had proposed to stay with on being granted bail were not prepared to offer him accommodation for fear of being attacked by those seeking revenge for the child’s murder. ENDS
