Broadhurst Chief Magistrate, Ms Faith Dlamini-N’gandu on April 17 denied two alleged fake Zimbabwean traditional doctors bail because they are purported to be a flight risk.

In the first count, the second accused, Chihwayi is charged for entering Botswana through an ungazetted point of entry. Particulars of the offence state that between November 2017 and April 14, 2018, exact date unknown, at or near Ramokgwebana, he entered the country by jumping the fence which forms the boundary between Botswana and Zimbabwe.  

On the second count, accused one, Nhiwatiwa and Chihwayi are alleged to have on or about April 15, 2018 at Gabane acting together and in concert being persons not authorised, licensed, or exempted had in their possession ostrich shells and a python skin.

On the third count, Chihwayi is charged for obtaining by false pretences. He is alleged to have between 2012 and 2013, exact date unknown to the prosecution, at Gabane obtained the sum of P10 000 from Kamogelo Setlalekgosi by falsely pretending that he was a traditional doctor, duly registered to practice in Botswana, and that he could assist to remove evil spirits from her whilst he knew that the representation was false.

Meanwhile, investigating officer, Assistant Superintendent Fidzani James told the court that accused two has similar previous charges before the same court, adding that the accused had also claimed that his passport was with Kanye CID office after it was confiscated following the murder and robbery charges he was facing.

The defence lawyer for the two accused, Mr Friday Leburu urged the court to sit within a period of seven days so that they could argue the issue of bail substantially. He said should the time elapse, he would approach the High Court. His plea was, however, not successful and the accused would return on April 30, 2018.
