Phadisa murder docket for DPP

Prosecutor in a case in which Daniel Phadisa is facing two counts of murder has informed the Broadhurst Magistrate Court that investigations into the murders were complete.

Updating the court during Phadisa’s mention yesterday (February12) on behalf of the substantive prosecutor, Sergeant Mothusiotsile Mekgwe of Broadhurst Police Station said they were currently working on compiling a photo album of the incident.

Sergeant Mekgwe further told the court that an additional statement has been recorded, and was to be typed and incorporated into the docket before it could be sent to the Directorate of Public Prosecutions (DPP) for assessment and possible prosecution.

The docket was initially forwarded to the DPP, but was withdrawn to accommodate more information.  

Phadisa’s dream of spending Christmas and New Year’s Eve outside prison were dashed on December 21, 2017 after magistrate Ms Wame Mosugelo, who was holding fort for magistrate Gaseitsiwe Tonoki, further extended his remand warrant at the request of the prosecution.

This time around he will also spend Valentine’s Day in custody.

Asked by magistrate Tonoki whether he has already applied for bail at the High Court, he said he was in the process of doing so.

Magistrate Tonoki had on several occasions declined to grant him bail on the basis that he might not turn up for trial looking at the gravity of the crime committed, but advised him to apply for bail at the High Court.

Though he has chosen to use English as a medium of communication, it has come to the realisation of the court that Phadisa is not well conversant with the Queen’s language and magistrate Tonoki had to slowly repeat what the prosecutor was telling the court so that he could have a better understanding of the events.

He will appear for another mention on February 26.

Phadisa allegedly murdered two women, Ms Bembe Magosi and her daughter Gomolemo Motladiile in Broadhurst location in Gaborone on September 30, 2017. Ends
