No bail for dagga dealers

Hukuntsi Magistrate, Ms Robin Sethantsho has refused to grant bail three men accused of being found in possession of a green substance suspected to be dagga.

Public Prosecutor, Assistant Superintendent Poloko Oteng indicated that the three accused persons; Mhiko Phenyo, Tshepang Baratang and Leatile Motlotliemang, were on April 8 found in possession of sachets containing green a substance suspected to be dagga at Magobelelo ward in Hukuntsi.

He further said that unlawful possession of dagga was contrary to Section 16 (1) (b) as read with Section 16 (4) of the Drugs and Related Substance CAP 63:04 of Botswana Laws.

Prosecutor Oteng requested that the trio be held in police custody pending completion of police investigations with regard to the origin of the green substance.

Magistrate Sethantsho agreed with Mr Oteng that the trio be remanded in Tshane Prison until the investigations are completed.

She also ordered the trio to show up before court on April 24, 2017.

On a similar case, 25-year-old Mr Mompati Mabinyane, who hails from Ga-Molaudi ward in Lehututu was found in possession of 51 clear plastic sachets containing a green substances suspected to be dagga.  

The accused was also charged with other two offences of being found in possession of government trophy, which is contrary to section 71 (2) ARW 71 (3) of the Wildlife Conservation and National Parks Act Cap 38:01 Laws of Botswana.

The accused requested for bail, which Magistrate Sethantsho denied him and ordered that he be held in custody at Tshane Prison until date of his next mention on April 24. ENDS
