Court revokes Nswazwi bail
10 Oct 2016
Molepolole Magistrate Court has cancelled bail for ex-soldier, Baangulanyi Nswazwi, of Mothombo ward in Mapoka who recently murdered the mother to her girlfriend.
Magistrate Lindiwe Makgoro had granted the murder accused bail after the prosecution failed to convince court why bail could not be granted.
Nswazwi’s girlfriend reportedly fled when her lover stormed their house leaving her mother, who would later be killed.
Magistrate Makgoro revoked the bail after the accused allegedly sent messages viewed to be provocative and threatening to the girlfriend, thus violating bail conditions.
The principal prosecution counsel Mr Enock Mahwite from DPP had pleaded for variation of the accused’s bail conditions arguing that him being freed could be a threat to the deceased’s relatives especially the deceased’s younger sister and the former girlfriend.
Mr Mahwite said it was for the court to use its discretion on varying Nswazwi’s bail conditions in consideration of circumstances surrounding the case.
The court dismissed plea by the defense counsel, Ms Dimpho Ramarumo, that the accused’s bail be considered at least by setting restrictions that would keep him away from possible prosecution witnesses.
The defense counsel further pleaded with the court to bear with the accused because the text message and the call that landed him in trouble wrongly landed into the former girlfriend’s phone.
Magistrate Makgoro dismissed the defense’s application by revoking his bail saying in view of the fact that the matter was new and he missed the target being the deceased’s daughter, was an indication that he might not rest until the mission was accomplished.
The suspect would appear again for mention October 13. ENDS
