Chief Magistrate Lenah Mokibe-Oahile of the Village Magistrate Court has postponed to April 16, a ruling in which murder suspect, Thabo Masilo wants her recusal from the case.
Defence lawyer, Mr Kgosietsile Ngakaagae had earlier in the week submitted that his client would not have a fair hearing as the presiding officer was bias in other offences that Masilo was charged with.
Mr Ngakaagae submitted that because of this biasness, his client had instructed him to withdraw the bail application but instead make it at the High Court where Masilo could be viewed through prism of the Constitution.
Masilo is facing murder charge, a single count of rape, indecent assault, robbery and breaking into a dwelling house. ENDS
