Rape accused to know fate May 16

Thirty-two-year-old Obakeng Molapo, who is charged for raping his stepdaughter in Lephephe, will know his fate on May 16 when Magistrate Bhekimpilo Sibanda of Molepolole Magistrate Court delivers judgement.

When giving his testimony recently, Molapo, who hails from Leretlweng Ward in Molepolole, said the complainant’s intention was to frame and tie him to an offence that he never committed.

He said the forensic report that was given by Ms Goitseone Ngomo of Botswana Police Service was confusing as he did not remember sexually assaulting the complainant. 

The forensic report revealed that the genital swabs which were extracted from the complainant matched the DNA of the accused, which corroborated the evidence that the accused might have committed the offence.

However, Molapo maintained that he did not have sex with the complainant, adding that when they headed to Lephephe after church in Kanye, they prepared and enjoyed dinner together. 

Molapo said when night fell, he went to his bedroom to sleep only for the complainant to call him later saying she was scared to sleep alone in the sitting room. She could not sleep in her bedroom since the light was not functioning, according to Molapo.

The accused said he then let the complainant to join him in his bedroom. “As we slept, I asked her if she could have sex with me and she refused, I left her in peace and we slept side by side until the following day,” said Molapo, adding that the following morning he headed to Palapye only to be called by the police who accused him of having raped the complainant the previous night.

However, Magistrate Sibanda ruled that the accused should submit his submissions in writing on or before April 24. Ends
