New labour law mandates employers to transport night shift employees

Night-shift workers will no longer have to navigate the challenges of unavailable public transport following the introduction of a new legal mandate requiring employers to provide door-to-door transit.
Responding to parliamentary question on Monday, Labour and Home Affairs Minister, Major General Pius Mokgware said the 2025 Employment and Labour Relations Act officially closed a long-standing gap in the previous labour laws regarding nocturnal commutes.
“The Employment Act CAP 47: 01 does not currently have any provision pertaining to provision of transport for employees working at night.However, the new Employment and Labour Relations Act of 2025, under section 217 (2) (b) mandates the employer to provide transport for night work employees. Transport will be provided from place of residence to work and back as from 1800 hours to 0600 hours,” Minister Mokgware said.
Jwaneng/Mabutsane MP, Mr Omphemetse Kwapa had asked the minister whether there was any law binding specific businesses to transport staff to and from work at night, particularly during hours when public transport was unavailable. ENDS
