07 Dec 2017

Assistant  Minister for Presidential Affairs, Governance and Public Administration, Mr Thato Kwerepe has informed Parliament that the Director of Public Prosecutions (DPP) was not  party to the settlement reached between President Lt. General Dr Seretse Khama Ian Khama  and the four Judges.

Responding to a parliamentary question on Wednesday, Mr Kwerepe said the settlement involved an exercise of power that the President has in terms of section 97 of the constitution of Botswana as read with section 14 of Public Authorities.

He noted that the settlements did not include a provision that DPP should cease the investigation or prosecution of the matter involving receipt of the Housing Allowance by the Judges.

Member of Parliament for Selebi Phikwe West, Mr Dithapelo Keorapetse had asked the minister if the DPP was or was not party to the negotiated settlement, and in the event that the DPP was not part of the settlement , what authority executive bind to cease investigations or prosecution into the matter.
