Three judges remain in office despite retirement

Parliament has been informed that judges who reached the mandatory retirement age of 70 and continued in office are justices, John Mosojane, Mpaphi Phumaphi and Lakvinder Walia. Minister of Defence, Justice and Security, Mr Shaw Kgathi said the three judges continued in office to enable them to deliver judgements and to complete the proceedings that commenced before they attained the mandatory retirement age.
Mr Kgathi said ‘the extensions of their appointments were not published in the Government Gazette as this is not a requirement of the law. He was responding to question posed by Selebi Phikwe West MP, Mr Dithapelo Keorapetse in Parliament on Tuesday.
MP Keorapetse had asked the minister if there were judges who had reached the mandatory retirement age of 70 whose contracts had been extended. Selebi Phikwe West legislator wanted the minister to state the names of the judges, when the three judges attained the age of 70, grounds for extension of their contracts and whether the contracts were gazetted.
