Application on default judgement deferred

Land Tribunal president, Ms Boitumelo Kaisara has deferred decission on an application by Molepolole businessman, Mr Ephraim Kgosiemang in which he requested that a default judgement imposed on him for failure to make appearance during the land dispute hearing in November last year be rescinded.
Mr Kgosiemang has made an application for the land tribunal to rescind its initial order issued over a land dispute between him and Kweneng District Council over a piece of land allocated for the use of cemetery at Ratlhomelang ward (Magokotswane) in Molepolole because the dates were not properly communicated to him.
The attorney representing Mr Kgosiemang, Mr Muller Keganne pleaded with the land tribunal to reconsider its decision since the date set for the hearing were never communicated to the appellant.
Mr Kgosiemang, commonly known as ‘Shialala’ had appealed the decision by Kweneneg Main Land Board that had ruled that a piece of land allocated to Kweneng District Council for the use of cemetery at Ratlhomelang ward, in Magokotswane did not belong to him.
Attorney Keganne emphasised that the hearing date was never communicated to the appellant and was only informed after the passing of the judgment, while upon hearing, the appellant made a move to enquire with land tribunal offices.
In responding, the attorney representing the second respondent, KDC Mr Ricardo Abueng dismissed the application, saying the accused was deliberately delaying the case for his selfish interests over that of the community.
“You are making unnecessary delays to become a hero by holding community at ransom,” charged attorney Abueng.
He pleaded with the court to dismiss the application made by the applicant, saying the court needed to look at the trend since the applicant was deliberately advancing excuses to buy time through delaying tactics. ENDS
