A 33-year-old Motswana pastor, Gotsilekgosi Mojadigo of The Divine Anointing Church International, has been granted bail by the Village Magistrate's Court after being charged with rape.
The pastor, accused of raping a minor in April this year, was today granted bail by Magistrate Daniel Nkau.
Mr Nkau stated that the prosecution failed to present a strong case for remanding the pastor, asserting that there was no evidence that he would interfere with witnesses who are part of his congregation.
The incident was reported to the Francistown police on May 8 and transferred to Gaborone two days later. However, it took the prosecution over a month to arrest and detain the accused. Mr Nkau questioned why the accused was not promptly arrested if there were concerns about witness interference, especially since the investigating officer admitted that the accused had been cooperative and had not attempted to obstruct the investigation.
Magistrate Nkau emphasised the principle of innocence until proven guilty, stating that only under exceptional circumstances should one's liberty be restricted. The pastor was granted bail on the condition of paying P5000, providing two sureties, refraining from interfering with state witnesses, surrendering his travel documents, abstaining from criminal activities while on bail, and attending all court hearings.
The state prosecutor mentioned that additional charges would be brought against the pastor at his next court appearance on August 29. Mojadigo, who is represented by Mr Samuel Plaatjie is said to have on April 23 this year near or at Block 10 in Gaborone without lawful excuse had carnal knowledge of a minor.
