Cybercrimes extraditable - minister

12 Feb 2013

All cybercrimes punishable with two year imprisonment sentence or more are extraditable, defence, justice and security minister, Mr Dikgakgamatso Seretse has said.

Responding to a question from Gaborone West North MP, Mr Robert Masitara, the minister said “in terms of the Cybercrime and Computer Related Crimes Act (Cap. 08:06), Section 29, an offence under this act shall be considered to be an extraditable crime for which extradition may be granted or obtained under the Extradition Act.”

The Extradition Act (Cap 09:03) at Section 2(2), states that “extradition crimes means a crime which, if committed within the jurisdiction of Botswana, would be an offence punishable with imprisonment for a term of not less than years or other greater penalty, and includes an offence of a purely fiscal character,” Mr Seretse said.

Mr Masitara had asked the minister to state the position of government on making cybercrimes extraditable offenses. ENDS
