Robberyrape case resumes tomorrow

Magistrate court in Kanye has put on hold sentencing for a robbery and rape case after the prosecution stated that the accused person lied in his final submissions.
Andy Lebele (28) of Gasita was found guilty of robbing a woman a Honda CRV vehicle valued at P35 000, FNB ATM card and hitting her with an axe handle.
The incident reportedly took place on September 16, 2018 at Mmabadisa Lands.
Still on the same date, the accused transported the victim in the same vehicle to Molapowaganamanyane lands near Mogojogojo where he raped her.
In his submissions, the accused had indicated that one of his extenuating circumstances was that he grew up in an abusive home and his father murdered his mother in his presence.
However, the prosecutor Mr Thabologo Bojosi told court that the investigating team went to Gasita and had since established that the accused person’s biological mother, Ms Seroba Lebele, was alive.
Additionally, he said contrary to the accused person’s claims that he was under the influence of alcohol when he committed the crimes, the prosecution believe that he planned the whole thing and applied his mind fully since he managed to monitor the complainant’s movements.
Mr Bojosi said the accused even knew that the complainant would go to the lands alone.
He also told the court that at the time the offences were committed, the accused was a fully grown adult of 26 years and therefore could differentiate between right and wrong.
However, since the accused person maintained that the said Ms Seroba Lebele was his aunt not mother, Magistrate Daniel Nkau ruled that she be brought before court tomorrow to establish her relations with the accused.
The accused would be remanded in custody pending sentence delivery. ENDS
