Public officers prohibited from participating from primary elections

Permanent Secretary to the President has released a statement on the position of the law concerning the participation of public officers in primary elections of political parties, as political parties commenced the holding of primary elections.

A press statement from the office says the Public Service Act (Cap.26:01) and the General Orders prescribe a politically neutral public service that is focused on serving the public without bias, favour or any undue consideration.

It further says the Public Service Charter principle of neutrality requires that public officers should remain politically neutral, and be seen to be politically neutral, as well as serve members of the public without any political influence and rendering them equal treatment.

“At any given time, irrespective of the party in power, public officers are expected to serve the government of the day, and faithfully provide uninterrupted service, coupled with adherence to the highest ethical standards,” says the release.

It also states that public officers are reminded about the position of the law, and are advised to refrain altogether from taking part in primary elections of political parties.

According to the statement, Section 5(5) (b) of the Public Service Act prohibits public officers from participating in primary elections of political parties and this position of the law is also confirmed by the Court of Appeal. Ends
